The Appellate Division of the Supreme Court has ruled that Aslam Chowdhury, the MP elected from Chittagong-4 (Sitakunda) constituency, will not be able to take oath due to loan default. The Appellate Division headed by Chief Justice Zubair Rahman Chowdhury announced the verdict today (June 30). Earlier, June 30 was fixed as the date for announcing the verdict after the hearing on June 15.
\nSenior lawyer Miftah Uddin Chowdhury and Barrister AM Mahbub Uddin Khokon were in favor of Aslam Chowdhury. Senior lawyer Mohammad Shishir Monir and Barrister ASM Shahriar Kabir were in favor of this Jamaat-e-Islami candidate in the court. Lawyer Md. Azim Uddin Patwari was also present at the time.
\nEarlier, the nomination papers of Aslam Chowdhury, accused of loan default, were declared valid on January 18, the last day of the appeal hearing at the Election Commission. After the High Court dismissed the bank’s writ petition challenging that decision, the bank authorities later appealed to the Appellate Division.
\nJamaat candidate Md. Anwar Siddiqui applied for leave to appeal against the High Court order. On February 3, the Appellate Division allowed the appeal against the confirmation of Aslam Chowdhury’s candidature. As a result, Aslam Chowdhury was allowed to contest the election. But the results were stayed until the appeal was disposed of and an order was issued not to publish them. Aslam Chowdhury won the February 12 election.
